The free downloads on Deviant Art and my blog site are for non-profit/personal use only. For business and commercial projects you must buy a standard or extended commercial license (see bottom of page).

When you download the free sets you are automatically bound by the following terms.

The brush sets are protected under a Creative Commons, Attribution, Non-Commercial license. You are required to link/credit back to this site when you use the brushes, unless stated otherwise.

The CC license means that you can use the brushes for:

Personal blog and website designs
Design work for charity (though contact me first please),
Personal artwork projects on deviant art or elsewhere
College or school

You can’t use them in any work that will make you or anyone else money. For example, the following are all classed as commecrial use..

Business web sites
Web layouts or commercial blog themes for re-sale
Design portfolios
Commercial blogs
Flyers/CD covers/myspace etc for bands
Corporate logos
Print on demand sites such as Zazzle, for apparel designs, posters, mugs etc – if you sell to the general public
Re-selling the sets
Digital scrapbooking commercial kits
CD covers
Magazines, advertising or other publications
Business cards
If you wish to use the brush sets on a non profit project, but WITHOUT a credit, you must purchase a commercial license.

For all commercial uses you must buy a license

Please note: Commercial usage of my work without permission will incur a fine and/or legal action taken against you.

Commercial Use
Please email me if you need a commercial license for the free sets, stating which brush set/pattern etc you would like to use, your name, business name, and an email address that you use with paypal. I will then make up your personalised license and send you a paypal invoice. Costs vary, but generally a license for a brush set costs £5, patterns around £3.

Everything in the shop includes a standard commercial license unless stated otherwise.

The Standard commercial license
The standard license is limited to a maximum of 2000 reproductions, whether in print on online. So if you use the brush design for digital scrapbooking sets, for example, you could only sell a maximum of 2000 copies. If using the designs for print, you could for example, only print 500 copies of a flyer, CD cover, magazine etc.

The Extended License
For higher quantities of reproduction (over 2000), you can either buy a standard license again, or you may buy an extended license. This operates on a sliding scale.

For print/tangible goods:
Up to 3000 reproductions, or use of the designs for business logos is £30
Up to 5000 reproductions of the design is £100
Unlimited reproduction of the design is £400

For web:
When incorporating my brushes into your own digital designs (online only), unlimited resale of your digital product (ie scrapbooking kits) is £100.

Remember that you are buying a license to use the design, not the design itself. I retain the copyright to the design.

Please contact me about extended licenses, stating your full name, address, and the usage you require.

You may re-distribute these sets for download on your own site, but you must mention my name, host the zipped set on your own server, link back to my blog site and not take credit for the designs as your own.

Please make sure that you specify that the brushes are under a CC license (link to the license page on my blog)

Clarification

Please contact me for advice if you’re unsure about the type of license you need for your project. You may be asked to produce your proof of purchase/print run receipt if there is doubt as to your usage of my images.
Indemnification

You agree to indemnify, defend, and hold harmless Melemel/MelsBrushes (hereafter referred to as Mels Brushes) against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use of this site and the use or the inability of use of any Image, your failure to abide by any restriction regarding the use of an Image, or any claim by a third party related to the use of an Image.

I OFFER NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING ANY IMAGES, THE WEBSITE, THE ACCURACY OF ANY INFORMATION, OR ANY RIGHTS OR LICENSES UNDER THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. MELSBRUSHES DOES NOT REPRESENT OR WARRANT THAT THE WEBSITE OR THE IMAGES WILL MEET YOUR REQUIREMENTS OR THAT THEIR USE WILL BE UNINTERRUPTED OR ERROR FREE.

MELSBRUSHES SHALL NOT BE LIABLE TO YOU OR TO ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR LOST PROFITS OR ANY OTHER DAMAGES, COSTS OR LOSSES ARISING OUT OF YOUR USE OF THE WEBSITE OR THE IMAGES.
